These General Terms and Conditions of Use, Privacy and Sales Policy (hereinafter, the "General Terms") govern the use of the website www.silvialeal.es/ (hereinafter, the "Website") that Silvia Leal (hereinafter, "SILVIA LEAL") makes available to those who access her Website, for the purpose of providing them with information about products and services, whether her own and/or those of third-party collaborators, and giving them access to the same, as well as enabling the contracting of services and goods through it (all of the foregoing referred to collectively as the "Services").

Owing to the very nature of the Website, as well as its content and purpose, virtually all browsing that may be carried out on it must be done while holding the status of Client, which is acquired in accordance with the procedures set out herein. Accordingly, the aforementioned status of Client entails acceptance of the General Terms in the version published at the time the Website is accessed. SILVIA LEAL reserves the right to modify, at any time, the presentation and configuration of the Website, as well as these General Terms. For this reason, SILVIA LEAL recommends that the Client read these terms carefully each time they access the Website.

In any case, there are pages of the Website accessible to the general public, with respect to which SILVIA LEAL likewise wishes to comply with its legal obligations, as well as to govern their use. In this regard, users who access these parts of the Website agree, by the mere fact of accessing the aforementioned pages, to be bound by the terms and conditions set out in these General Terms, to the extent that they may be applicable to them.

Finally, owing to the nature of this Website, the content of these General Terms may be modified or amended. For this reason, the Client, as well as other users who do not hold such status, are obliged to consult these General Terms each time they access the Website, accepting that the corresponding conditions in force at the time of their access shall apply to them.

ACCESS AND SECURITY

Access to the Services requires prior registration by users, who, once they accept the General Terms, become considered Clients.

The Client's identifier shall consist of their email address and a password. To access the Client's own account, it will be necessary to enter this identifier, together with a password that must contain at least 4 characters.

The use of the password is personal and non-transferable, and its assignment to third parties, even temporarily, is not permitted. In this regard, the Client undertakes to make diligent use of the password and to keep it secret, assuming full responsibility for the consequences of its disclosure to third parties.

CORRECT USE OF THE SERVICES

The Client undertakes to use the Services in a diligent, correct and lawful manner and, in particular, by way of example and without limitation, undertakes to refrain from:

SILVIA LEAL shall at all times ensure compliance with the legal order in force, and shall be entitled to interrupt, at its sole discretion, the Service or to exclude the Client from the Website in the event of the alleged commission, whether complete or incomplete, of any of the offenses or misdemeanors classified under the Criminal Code in force, or in the event of observing any conduct that, in the opinion of SILVIA LEAL, is contrary to these General Terms, the General Contracting Conditions applicable to this Website, the law, the rules established by SILVIA LEAL or its collaborators, or that may disrupt the proper functioning, image, credibility and/or prestige of SILVIA LEAL or its collaborators.

PROPERTY RIGHTS

All content on the Website, such as texts, graphics, photographs, logos, icons, images, as well as the graphic design, source code and software, is the exclusive property of SILVIA LEAL or of third parties whose rights in this respect are legitimately held by SILVIA LEAL, and is therefore protected by national and international law.

Such services, information and materials are presented "as is" and are accessible without warranties of any kind.

SILVIA LEAL reserves the right to interrupt access to the Website, as well as the provision of any or all of the Services provided through it, at any time and without prior notice, whether for technical, security, control or maintenance reasons, due to power supply failures, or for any other justified cause.

Consequently, SILVIA LEAL does not guarantee the reliability, availability or continuity of its Website or of the Services, so that their use by the Client is carried out at the Client's own account and risk, and no liability may at any time be demanded from SILVIA LEAL in this respect.

SILVIA LEAL shall not be liable in the event of interruptions to the Services, delays, errors, malfunction, and, in general, other inconveniences originating from causes beyond the control of SILVIA LEAL, and/or due to willful or negligent action by the Client, and/or originating from acts of God or force majeure. Without prejudice to the provisions of Article 1105 of the Spanish Civil Code, the concept of Force Majeure shall also be understood, for the purposes of these General Terms, to include all those events occurring outside the control of SILVIA LEAL, such as: failure of third parties, operators or service companies, acts of Government, lack of access to third-party networks, acts or omissions of Public Authorities, those others produced as a consequence of natural phenomena, blackouts, etc., and attacks by hackers or third parties specialized in the security or integrity of the computer system, provided that SILVIA LEAL has adopted reasonable security measures in accordance with the state of the art. In any case, whatever its cause, SILVIA LEAL shall assume no liability whatsoever, whether for direct or indirect damages, consequential loss and/or loss of profit.

SILVIA LEAL excludes any liability for damages of any nature that may arise from the lack of truthfulness, accuracy, completeness and/or currentness of the Services transmitted, disseminated, stored, made available or received, obtained or accessed through the Website, as well as for the Services provided or offered by third parties or entities. SILVIA LEAL will, to the extent possible, endeavor to update and rectify any information hosted on its Website that does not meet the minimum guarantees of truthfulness. The Client undertakes to hold SILVIA LEAL harmless from any damage, loss, penalty, expense (including, without limitation, attorneys' fees) or civil, administrative or any other type of liability that SILVIA LEAL may suffer in relation to the Client's breach or partial or defective fulfillment of the provisions set out in these General Terms or in applicable legislation, and, in particular, in relation to its obligations concerning the protection of personal data set out in these terms or established in the LOPD (Spanish Data Protection Act) and its implementing regulations.

SILVIA LEAL does not guarantee or assume any liability whatsoever for damages suffered as a result of accessing third-party Services through connections, links or hyperlinks of the linked sites, nor for their accuracy or reliability. APPLICABLE LAW AND JURISDICTION

For any interpretative or contentious matters that may arise, Spanish law shall apply, and in the event of a dispute, both parties agree to submit, waiving any other jurisdiction that may correspond to them, to the courts and tribunals of the city of Madrid.
